Obligation Qualified
Last updated: 06-Oct-2014

GH Renton & Co Ltd v Palmyra Trading Corporation of Panama [1956] 3 All ER 957.

Per Lord Morton of Henryton at page 965:

No conflict arises when an obligation in a contract, unqualified in its terms as it is first stated, is subsequently qualified by a proviso or altering the obligation if certain events happen which are outside the control of either party. The original obligation and the qualification of it both form part of the intention of the parties, and neither part is repugnant to the other.
